Lesotho's new Occupational Safety and Health Act raises the bar. A practical breakdown for contractors.
The Occupational Safety and Health Act No. 4 of 2024 modernises Lesotho's workplace safety framework and places clearer duties on employers, contractors and principals.
Duty of care is explicit
Employers must identify hazards, assess risks and implement controls — and be able to show that they did. Documented risk assessments are no longer optional extras.
Contractor management
Principals are expected to vet contractors' safety capability before mobilisation. Expect more rigorous H&S file reviews from network operators and utilities.
What to do now
Update your legal register, review your risk assessments against the new provisions, and ensure appointment letters and training records are current.
